In the Matter of Gregory Garcia v. New Jersey Police Training Commission

In In the Matter of Gregory Garcia v. New Jersey Police Training Commission (Nov. 7, 2025), the New Jersey Appellate Division upheld the Commission’s mandatory revocation of Garcia’s law-enforcement license after his conviction for possessing a large-capacity ammunition magazine. The court rejected Garcia’s arguments that revocation was premature because his appeals were still pending and that the Commission retained equitable discretion to decline revocation “in the interests of justice.” Citing clear statutory language requiring revocation upon conviction—regardless of pending appeals—and distinguishing discretionary pension-forfeiture cases, the court held that the Commission acted properly and had no authority to delay or avoid revocation.
